CA: New Grand Jury Subpoenas Related to UC-Santa Cruz Investigation

From Green is the New Red

At least two individuals have been subpoenad to a federal grand jury that appears to be investigating a 2008 fire at the home of an animal experimenter at the University of California, Santa Cruz.

One of the people subpoenaed, José Palafox, said:

“I was approached by two FBI agents at the BART Station at 19th and Broadway in Oakland. They asked my name, identified themselves as Carrie and Matt from the FBI, and served me a subpoena to testify before a federal Grand Jury. They informed me that I had been served and left without asking me any other questions….

“I know nothing about the Santa Cruz action but believe this is a political prosecution and part of a government attempt to gather information on activists, specifically involved in the animal rights movement.”

Grand juries are often used to compel political activists to testify about their political beliefs and political associations. When activists enter a grand jury, they check their rights at the door. Those who refuse to take part in these political witch hunts face prison time. [Utah animal rights activist Jordan Halliday is currently in prison for his principled stand .]

In addition to Palafox, at least one other person has been subpoenaed, and another received a visit from the FBI.

Grand juries are secret, but there is some information about the scope of this one. The 2008 fire was also at issue in the prosecution of the “AETA 4″ on animal enterprise terrorism charges (which were all dismissed). And the prosecutor in that case, Assistant U.S. Attorney Elise Becker, is also involved in this grand jury.

I’ll post more information as it becomes available. In the meantime, if you are contacted by the FBI or receive a grand jury subpoena, immediately contact the National Lawyers Guild hotline,  (888) 654-3265. Also, watch this video.

Chile: The Bombs Case trial is suspended

from solidaridadporlxspresxs, transl waronsociety:

URGENT: THE BOMBS CASE TRIAL IS SUSPENDED.
The prosecution’s tricks and ruses could annul the whole trial.

On May 11, 2012, the court of appeals decided this time to accept a challenge made by the Southern Prosecution of the Ministry of the Interior in which the judges are accused of bias and lacking in impartiality.

Courtroom one of the appeals court voted in the majority to accept the challenge, immediately paralyzing the trial. The judges who have until recently carried out the trial — Marcela Duran Sandoval, Carlos Carrillo and Blanca Rojas — of the Third Oral Criminal Tribunal will have to send out report soon about the accusations that the prosecution is making, while meanwhile the ruling indicated that they should “abstain from further intervention” until the challenge is resolved. Which in other words means the complete and absolute stoppage of the bombs case political trial, which has already gone on for more than 107 days of hearings, and almost 6 months of inquisitorial process.

The trial was continuing its course, and had gotten to the presentation of evidence and witnesses by Francisco Solar’s defense, Mónica Caballero’s defense, and it was at Omar Hermosilla’s defense when the trial was paralyzed. Continue reading

Uruguay: Urgent! Solidarity with an imprisoned comrade!

From Anarchist News

On the 10th of May, our brother, friend and compañero David Lamarte was imprisoned.

David is being processed by the courts, and faces a sentence that ranges from 3 months to 3 years, though this has not yet been determined. They are accusing him of having broken some taxi metres on May 1st, during a working class action that opposed the official union, who are basically on the side of the government. David is a friend and anarchist who has been in struggle with us for over 15 years, from his participation as an adolescent in the old Anarko Punk Resistence, to the picket lines in the Sindicato Unico de Automovil con Taximetros y Telefonistas (Automobile, Taximetres and Telephone Operators Trade Union), and currently, within various anarchist collectives.

The SUATT, formerly the SUA, was the union stronghold for direct action, which maintained the old Federacion Obrera Regional Uruguaya (Regional Uruguayen Labour Federation)throughout the 20th century. Today, it is one of the most combative unions in the country, who must also fight against the arrogance of mafia bosses and constant police harassment. We are asking comrades to pass this information on as far and wide as possible. Any and all expression of solidarity are appropriate.

Cleveland Anarchists, Pax and Support for Long Term Anarchist Prisoners

From Asheville FM – Final Straw

This week’s show features two conversations around the FBI, prisons and anarchists.

The first is with Will Potter, author of Green is the New Red and blogger at greenisthenewred.com. Will is an award winning, independent journalist based out of Washington, D.C. Our conversation revolves mostly around the recent case of anarchists in Cleveland entrapped into plotting destruction of infrastructure by the FBI and an informant.

The second conversation is with Ian Coldwater. This show is also in preparation for the upcoming June 11th International Day of Solidarity with Long-Term Anarchist Prisoners. Ian updates us on Marie Mason and Eric McDavid, two of the main focuses of his recent tour of the U.S. called Never Alone, in run-up for June 11th. Ian also speaks about security culture, revolutionary solidarity and growing cultures of resistance, as well as updates us on the cases of Pax in Portland (accused of property destruction) and the Grand Jury in the S.F. Bay Area.

Italy: Italian anarchists kneecap nuclear executive and threaten more shootings in solidarity with imprisoned comrades

From the press

An anarchist group claimed responsibility on Friday for kneecapping an Italian nuclear engineering executive and warned it would strike another seven times at the firm’s parent company, Finmeccanica.

In a four-page letter sent to an Italian newspaper, the group, calling itself the Olga Nucleus of the Informal Anarchist Federation-International Revolutionary Front, said two of its members had shot Roberto Adinolfi, the CEO of Ansaldo Nucleare, in Genoa on Monday.

The firm is owned by Italian state-controlled defence and aerospace group Finmeccanica, which operates 16 sites and employs 10,000 people in the UK. Continue reading

VA: Solidarity for Jeremy Hawthorne, Jailed Anarchist, Richmonder, Friend

From Jeremy Commissary @ Chipin

“Jeremy’s said he needs about $30 a week to pay for decent non-carnivorous food, stamps, sanitary supplies, and so on. Assuming a release date sometime in August, he’ll need somewhere near $500 all up from now til his release.

I’m assuming like roughly $100 will go to the ChipIn, Paypal, and jail percentages. We can minimize the amount of money wasted (and given to the state!) by donating it all at once.

So, put up some cash for our friend!”

Help make Jeremy’s time easier in jail by donating money so he can have phone privileges to call his family (collect!), write letters (paper & stamps cost dollars), and eat something vegetarian (mostly Cheetos & Ramen minus the flav packet).

I know he and all of his loved ones will really appreciate it. Continue reading

CA: Free Julio!

From Ideas & Action

Julio Rodriguez, a stalwart comrade of ours from Los Angeles, has been held in prison since Saturday under threat of immediate deportation. We will not let another one of our brothers be kidnapped from us by the racist state!

Julio is an anarchist youth organizer with the Youth Justice Coalition and RiseUp LA, radical groups that run out of Chuco’s Justice Center in Inglewood, CA. He is a student at Free LA High School at Chuco’s where he is studying to get his GED. Julio is prominent in the LA punk scene, organizing and promoting DIY shows, and encouraging the politicization and education of kids in the scene.

This past Saturday, Julio was hosting a Cinco de Mayo party at his house. When he noticed that someone had stolen his laptop, he shut down the party and told everyone they needed to leave, but a group of them refused. Julio knocked on the side of their car to get them to leave, but rather than drive away, the group called 911. The Sherriff’s deputies arrived and arrested Julio for vandalism. He was taken to Men’s Central Jail where he is currently detained. Julio’s family posted bail for him on Sunday, but ICE put an immigration hold on him and will not allow him to be released until the hold is resolved. If the immigration hold is not dropped, Julio will be transferred to an ICE detention facility and then be deported to Mexico, where he has not lived since his infancy. Continue reading

Challenging Convictions: Survivors of Sexual Assault/Domestic Violence Writing on Solidarity with Prison Abolition

From This is Our Job

DEADLINE EXTENDED Completed submissions due: June 15, 2012.

Like much prison abolition work, the call for this anthology comes from frustration and hope: frustration with organizers against sexual assault and domestic violence who treat the police as a universally available and as a good solution; frustration with prison abolitionists who only use “domestic violence” and “rape” as provocative examples; and, frustration with academic discussions that use only distanced third-person case studies and statistics to talk about sexual violence and the Prison Industrial Complex (PIC). But, this project also shares the hope and worth of working toward building communities without prisons and without sexual violence. Most importantly, it is anchored in the belief that resisting prisons, domestic violence, and sexual assault are inseparable.

Organizers of this anthology want to hear from survivors in conversation with prison abolition struggles. We are interested in receiving submissions from survivors who are/have been imprisoned, and survivors who have not. Both those survivors who have sought police intervention, as well as those who haven’t, are encouraged to submit. We are looking for personal essays and creative non-fiction from fellow survivors who are interested in discussing their unique needs in anti-violence work and prison abolitionism.

Discussions of sexual assault, domestic violence, police violence, prejudice within courts, and imprisonment cannot be separated from experiences of privilege and marginalization. Overwhelmingly people who are perceived to be white, straight, able-bodied, normatively masculine, settlers who are legal residents/citizens, and/or financially stable are less likely to experience violence, while also less likely to encounter the criminal injustice system than those who are not accorded the privileges associated with these positions. At the same time, sexual assault and domestic violence support centers and shelters are often designed with certain privileges assumed. We are especially interested in contributions that explore how experiences of race, ability, gender, citizenship, sexuality, or class inform your understandings of, or interactions with cops, prisons, and sexual assault/domestic violence support. Chile: Update on the “bombs case” political trial, April 16 to 27

From liberaciontotal, transl waronsociety

These were the final weeks of the prosecution’s evidence in the first oral trial under the anti-terrorist law against the anarchist and anti-authoritarian specter, one of the longest of the criminal procedure reform.

Whose signature?

It is again made clear how the police, especially the carabineros, in their continual reports “change” their signatures. After innumerable similar episodes during the trial, no witness or expert could recognize or know whose signature it was that was impersonated. Finally, on the last day of the prosecution’s evidence, a witness acknowledged that he had signed some reports of other police officers.

Chain of custody lost

All the evidence has a document called “chain of custody” that is a part where the police write the site where it was taken from and who else had examined it, the only record of hands passing the evidence in question.

The prosecution introduces a piece of evidence to the tribunal, and in their complete disorder they take out the chain of custody and lose it. After not finding this document (the chain of custody), the prosecution tries to blame the functionary in charge of the tribunal, after the bickering in which they indicated that it was the prosecution itself that took the chain of custody, the judges decided to suspend the hearing until the document finally appeared. After a couple of days the prosecutors arrived as if nothing had happened, and without denying the accusations that they themselves had made in order to absolve themselves of responsibility, they brought the chain of custody that they acknowledged having found in their own offices.
